Worker’s Compensation Claims are different than personal injury claims.
Workers’ Compensation is insurance coverage purchased by an employer or business that provides benefits for job-related employee injuries. Florida law requires all employers to purchase workers’ compensation coverage (with a few exceptions). Under a workers’ compensation policy, employees are compensated for occupationally incurred injuries, regardless of fault.
By contrast, in personal injury claims, liability is important, and injured individuals are entitled to compensation for pain and suffering in addition to loss wages and medical bills.

There are two instances where someone who was injured on the job and pursuing a workers compensation claim, could also have a personal injury claim, that is, when there is gross negligence involved, or if there is a third party that is responsible for the injury.

For example, if you are working on a construction site and are injured while using a jackhammer, and it turns out that the jackhammer was defective which caused your injury. In this case, your employer would not be the only one responsible, and you may have a personal injury case against the manufacturer of the jackhammer.
