Rather, we work on a contingency fee, meaning that the attorney’s fee will be a percentage of the final settlement that a client receives. In Florida, the standard contingency fee is 33 ⅓ percent of the settlement if the case is resolved prior to filing a lawsuit, and 40 percent of the settlement or verdict if the case requires litigation. Most of our cases resolve prior to litigation, incurring a fee of 33 ⅓ percent (one third) of the settlement.
